PragmaConnect Terms of Use

PragmaConnect is a healthcare integration platform developed and owned by JAWK Softwares. These Terms of Use govern your access to and use of PragmaConnect. By accessing or using the platform, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.

1. Acceptance of Terms

You must be at least 18 years old to use PragmaConnect. By accessing or using the platform, you confirm that you have the legal authority to enter into a binding agreement and that you agree to comply with these Terms.

2. Account Registration & Security

To access certain features, you may be required to create an account. You agree to provide accurate and complete information during registration and keep your information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify JAWK Softwares immediately of any unauthorized use of your account.

JAWK Softwares reserves the right to suspend or terminate accounts that violate these Terms.

3. Permitted Use

PragmaConnect may only be used for lawful purposes and in accordance with these Terms.

You agree not to:

  • Reverse-engineer, decompile, or try to discover the source code of PragmaConnect.
  • Distribute, resell, or sublicense the platform without permission.
  • Introduce viruses, worms, or other harmful code.
  • Use the Service for any unlawful or unauthorized purpose (including violating privacy or intellectual property rights).
  • Engage in activities that could harm or disrupt the Service (e.g., denial-of-service attacks or hacking attempts).
  • You must comply with all applicable laws and regulations when using PragmaConnect. For example, if you handle protected health information (PHI), you must follow the privacy rules of HIPAA or other relevant healthcare data laws.

4. Data Responsibility

The organization using PragmaConnect is responsible for ensuring that all data processed through the platform complies with applicable laws and regulations. This includes:

  • Ensuring that any patient or personal data is lawfully obtained and that consents are in place.
  • Ensuring patient or personal data is lawfully obtained.
  • Maintaining appropriate patient consent where required.
  • Complying with HIPAA, GDPR, or other applicable privacy regulations.
  • Implementing appropriate safeguards for protected health information.

PragmaConnect provides the technology to facilitate data exchange, but does not assume responsibility for the legality or compliance of the data you transmit.

5. Intellectual Property

PragmaConnect is a proprietary technology platform developed and owned by JAWK Softwares.

All rights, title, and interest in the platform remain exclusively with JAWK Softwares, including but not limited to:

  • Platform architecture and infrastructure
  • Integration frameworks, connectors, and interoperability engines
  • APIs, data mapping frameworks, and transformation logic
  • Software code, workflows, algorithms, and system design
  • Platform interfaces, documentation, and configuration materials
  • The name PragmaConnect, associated logos, and trademarks.

Your use of the platform grants you a limited, non-exclusive, non-transferable license to access and use PragmaConnect solely for your internal business purposes.

You may not:

  • Copy, modify, distribute, or create derivative works of the platform.
  • Reverse engineer or attempt to extract proprietary technology or system architecture.
  • Replicate, benchmark, or build a competing integration or interoperability platform using PragmaConnect or its components.
  • Use or expose the platform’s APIs or integrations outside authorized use.

All proprietary technology, platform methodologies, and integration frameworks used within PragmaConnect are considered confidential and protected intellectual property of JAWK Softwares.

6. Third-Party Integrations

PragmaConnect enables integrations with third-party EHRs and healthcare systems. JAWK Softwares is not responsible for the functionality, availability, or security of any external systems. Your access to third-party platforms may be subject to additional terms from those providers. You must ensure you have all necessary permissions to connect PragmaConnect with any external system or data source.

7. Service Availability

PragmaConnect is provided on an “as-is” and “as-available” basis. JAWK Softwares does not guarantee uninterrupted access. The Service may experience downtime due to maintenance, updates, or issues with underlying infrastructure. JAWK Softwares is not liable for any losses or damages resulting from service unavailability or data loss.

8. Disclaimer of Warranties

To the fullest extent permitted by law, JAWK Softwares disclaims all warranties regarding PragmaConnect. This means the Service is provided without any warranty of any kind, either express or implied. JAWK Softwares does not guarantee that PragmaConnect will meet your needs, operate without interruption, or be free of errors. You use the platform at your own risk.

9. Limitation of Liability

JAWK Softwares will not be liable for any indirect, incidental, special, or consequential damages arising from the use of PragmaConnect. This includes loss of profits, loss of data, or business interruption, even if JAWK Softwares has been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless JAWK Softwares and its employees, officers, and affiliates from any claims, liabilities, damages, or expenses arising from:

  • Your use of PragmaConnect.
  • Your violation of these Terms.
  • Your failure to comply with applicable laws or regulations.

11. Suspension or Termination

JAWK Softwares may suspend or terminate your access to PragmaConnect at any time if you violate these Terms or if required by law. Upon suspension or termination, your rights under these Terms will cease immediately, and you must stop using the Service. Sections concerning disclaimers, liability, and intellectual property will survive termination.

12. Changes to Terms

JAWK Softwares may update these Terms from time to time. Updated Terms will be posted on the website or platform. Continued use of PragmaConnect after changes are posted constitutes acceptance of the updated Terms.
